The courts define "sexual harassment" as any unwelcome behaviour of a sexual nature. It can be physical (unwelcome touching or gesturing), verbal (unwelcome lewd remarks, sounds or requests) or visual (unwelcome exposure to sexual imagery). This harassment adversely affects the condition of an individual's employment, and interferes with an employee's work performance creating an intimidating, hostile, or offensive work environment.
The Sexual Harassment at The Workplace Act has made it mandatory for every employer to form an Internal Complaints Committee (ICC) to ensure that sexual harassment does not occur, and when it does occur, help is available readily to deal with the problem and prevent it from happening again. This committee must be headed by a woman, and half of its members must be women as this issue needs understanding, empathy, sensitivity, compassion and commitment.
